The Canadian Radio-television and Telecommunications Commission (CRTC) has informed GoodLife Fitness Centres Inc. (GoodLife) that a number of calls made on its behalf by a third party vendor to its members initiated between 1 May 2010 and 15 December 2010 constituted violations of Part IV, section 2 of the Unsolicited Telecommunications Rules (the Rules) made by the CRTC pursuant to section 41 of the Telecommunications Act. Specifically, the calls were made to GoodLife members’ numbers via an Automatic Dialing and Announcing Device (ADAD), without obtaining the prior express consent of such members.
In recognition of the CRTC’s concerns and because of GoodLife’s commitment to ensure compliance with the Rules, GoodLife has voluntarily agreed to, among other things, pay an administrative monetary penalty and implement a comprehensive compliance program to ensure that such violations do not occur in the future. The CRTC has agreed to review GoodLife’s practices and procedures to foster compliance with the Rules.
